Student thesis: Master's Thesis

Abstract

The sale and purchase of consumer goods present in the Decree-Law 84/2021 of the 18th of October by the Portuguese Government is the result of the EU legislator's concern to boost the increasingly digital international market. One way to achieve this is through the creation of common rules in the European zone, but also through a high level of consumer protection, so that consumers feel secure in their transactions. With this study, there will be an analysis of the Decree-Law, focusing on its scope, the non-conformity of the goods to the contract and finally, the consumer's rights in the event of non-conformity. There are several issues that the Decree-Law addresses: from the outset, the definition of consumer, the hierarchy of remedies, as well as new features such as the right to reject a lack of conformity shown or discovered within the first 30 days.
