Portuguese law recognizes some rights to the surviving member of the de facto unions, namely the right to maintenance on the deceased's estate, rights to the family home and furnishing, the right to get social benefits on death and also the right to compensation for non-pecuniary damage resulting from the death of the de facto partner. This study concludes that this protection is insufficient and suggests changes to strengthen it, such as including the surviving unmarried partner in the list of legal beneficiaries, with precedence over the deceased's siblings and nephews.
