The present dissertation arises due to an increasingly recurrent social context: the presence of drones used by individuals in their daily life. The use of drones in this context serves, essentially, for recreational purposes, being operated by individuals who use them solely for leisure. Due to technological advances and the need for merchants to meet the needs of their consumers, this reality has been growing and being seen as normal. However, even if we understand the adherence to this technological equipment, it should be noted that it is likely to violate the privacy and protection rights of personal data of individuals who are subject to this technology. And so it is, given the equipment that can be attached to drones. This raises an issue that we believe fits the figure of collision of rights, confronting the right to use drones with the rights to privacy and protection of personal data. Precisely because this is a current and growing reality, it is urgent to present an answer to this problem. And that is the goal that we propose to fulfill through this dissertation.
