For centuries, women have been the ‘invisible victim’ of armed conflict. Rooted in the sexist and patriarchal context of war, Sexual Violence is seen as an almost inevitable consequence of it. Throughout this essay we will analyze the evolution of international law on the subject, namely regarding it ceasing to be a mere consequence of armed conflict, to being established as a War Crime, Crime Against Humanity, and Genocide. We’ll be doing that by intertwining this legislation with its applicability, particularly though the analysis of jurisprudence of the International Criminal Court for Yugoslavia, International Criminal Court for Rwanda and the International Criminal Court, which became a cornerstone regarding progress in Women’s Rights and the combat on the impunity of the aggressors and prevaricators of International Law on this subject.
