Abstract

The development of information and communication technologies, exponentially accelerated by the need to avoid sources of COVID-19 outbreaks during the pandemic, forced companies to adapt to this new reality, making telework an attractive and widely used modality in the labor landscape. Although telework presents some benefits for both employers, by allowing the reduction of operational costs, and workers, by facilitating the balance between professional and personal life, it is undeniable that the current legislation is not fully equipped to address the challenges of this modality, particularly regarding the characterization of accidents occurring in the context of telework. In this regard, the present study aims to examine the different concepts that define the traditional work accident — the workplace, working time, and causal connection— and their application, adapting them to the reality of telework. As such, we will analyze legal doctrine and case law from other legal systems, in an effort to better identify and dissect the incompatibilities presented by the current work accident compensation regime. Additionally, we will explore a distinct perspective on the issue of privacy, which is challenged by the mandatory consent to home visits, as well as the possible introduction of alternative solutions, such as the self-responsibility of teleworkers.
