Abstract

This dissertation focuses on occupational accidents involving professional athletes, analyzing the relevant legal framework and the main issues arising from its application. The research is structured around three key aspects: the determination of the scope of professional athletes under Law No. 48/2023, the causal link between an event and an injury, the issue of work-related accidents occurring while serving on national teams and, finally, the management of sports calendars as a preventive mechanism for accidents. The primary objective of this study is to evaluate the extent to which the current legal framework ensures effective protection for professional athletes, identifying potential gaps and interpretative challenges while proposing solutions to improve the legislation’s implementation. The approach adopted is predominantly legal-dogmatic, based on a critical analysis of applicable legislation, doctrine, and case law, complemented by a comparative perspective with the Spanish legal system, given the great geographical proximity to our country. In this way, we aim to analyze a legal framework different from the one we abide by and to identify the differences at this level in countries that are so close and share remarkably similar sports cultures. The dissertation also examines the interaction between labor law and sports law to highlight the specificity of sports employment contracts and the challenges associated with their regulation. The findings reveal that, despite the progress introduced by Law No. 48/2023, significant issues persist, along with the need for broader discussions among legal scholars, federations, and athletes to better adapt the legal framework to the demands of professional sports.
