Abstract

This dissertation analyzes the suitability of arbitration as a means of resolving disputes related to Environmental, Social and Governance factores Given the growing incorporation of ESG obligations, both legislative and contractual, into the corporate context, there is a need to explore effective mechanisms for their resolution, with a special focus on commercial arbitration. To this end, this research evaluates the role of commercial arbitration to settle disputes arising from non-compliance with ESG obligations, exploring the main advantages and limitations of this means of dispute resolution.
