Abstract

The demarcation between a worker's personal and professional life is of great importance. Nonetheless, there are events in the employee's private sphere that
affect the employment contract, such as the employee's pre-trial detention or conviction. With regard to these issues, there is a legislative vacuum, since the law does not deal with the impact that personal life can have on professional life. This issue, due to its urgency and topicality, is being debated by doctrine and case law.
