Abstract

Over the years, there has been a gradual recognition of the dignified position assumed by the child in the family and in society, along with the awareness of the incomparably relevant role of parents in the exercise of parental responsibilities over their children. The Convention on the Rights of the Child’s contribute was fundamental to this end and leads the justice on the most inexperienced and vulnerable human beings by imposing the principle of the best interests of the child as a guiding criterion for all the matters that concerns the child. Ideally, all the children’s families should guarantee a healthy growth focused on love, concern and respect. However, it is not uncommon for parent’s behaviour to be contrary and harmful towards the harmonious development of their children, who have the right of protection by society and the State. This dissertation arises from an analysis of the legal consequences that occur from the violation of the right to physical and psychological integrity of children by their parents. Therefore, we propose to explore the legal options presented by the Law, in order to safeguard the rights of children in danger within the family.
