The present dissertation was carried out within the scope of the Master in Law, with a specialization in Criminal Law, held at the Faculty of Law of the Catholic University of Porto. With this work we intended to analyze the Rights of the Suspect, the Defendant and the Inmate along with the respect for the Constitutional requirements in the Portuguese Criminal Procedure, conveyed the reality through concrete cases. The restriction of the right to freedom was evaluated in the different procedural stages, namely through the application of coercive measures. It was intended to analyze what results from the increasingly intense relationship between justice and the media and the risks it entails for a fair process, specifically the respect for the presumption of innocence and the defendant's right to defense.
