Patent laws grant patents with a view to protecting certain inventions, but exclude others, and can often be on the threshold between providing sufficient incentives to stimulate innovation and avoiding the dangers of over-protection. Currently, Boards of Appeal, at the EPO, have been tasked with interpreting the European Patent Convention in line with technological developments. As will be discussed in this paper, this task has often caused disparities. The recent culmination of this phenomenon is the very important reference to G 1/19, concerning the patentability of computer implemented simulations. This case has the potential to shed light on the patentability of computer-implemented inventions in Europe.
