Technological innovation has contributed to the rise of a new business organization model: collaborative economy (or UBER economy). The increasing number of companies operating in this model highlighted them on the market. Its boosting relevance and dimension raises several very interesting legal issues, in particular those related to competition and labor law. In this study we intend to deal with the integration of this new reality in law dictates by putting in crisis the adequacy of current labor law to the regulation of relations between companies (so-called technological) and its employee / service providers. We will question their qualification as employee and evaluate the evidential method and its traditional indicators’ application to this new type of workers. With the aim of achieving the solution that will safeguard the protection of these and the growth expectations of those companies, we will approach the possibilities for self- regulation, collective bargaining and legislative intervention.
