Abstract

Blockchain and Smart Contracts technologies have been gaining recognition in the context of implementation alongside with Law, where their relationships with Administrative Law and more specifically with the field of public procurement. The functionalities of these technologies bring a new perspective to the use of means within this field of Public Law. With these functionalities, public procurement can adapt to technological advances, offering a greater level of transparency and security both for public entities and for individuals who want to participate in the procedures. In this way, and due to this transparency, new technologies will be able to offer greater confidence to the general public, which will result in a greater belief of citizens in the performance of public entities. Thus, we propose to analyze the particularities of Blockchain and Smart Contracts technologies in the context of public procurement, analyzing three case studies and discussing the advantages and disadvantages of using these new technologies.
