Abstract

This dissertation focuses on the ownership and forms of selling of television and media broadcasting rights of content associated with the professional football competitions in Portugal. In the scope of this dissertation, we pointed out the agreements that are currently in force in Portugal, foreseeing how the future of the sale of these rights may evolve in the light of recent and relevant legislative shifts. Therefore, in this thesis, we classified the media rights both in the international and national markets, elaborated an overview of the historical evolution and present state of the media rights in Portugal, addressed the different legal and competition concerns of a collective commercialization, and, finally, presented how, and through which tools, this system may prevent the above-mentioned concerns and benefit the development of the market. Thus, among others, we identified and characterized the adoption of instruments such as limiting the duration of exclusivity, unbundling of rights and the implementation of a single buyer clause, the use of rules for participation in auctions and use it or lose it clauses.
