Abstract

This dissertation aims primarily to examine the concept of banking compliance, introducing its role within financial institutions. The study is dedicated to the analysis of money laundering and corruption crimes, as well as the investigation of the legal frameworks and mechanisms employed to combat these offenses in the United States and Brazil. A comparative assessment is conducted between the two countries regarding the effectiveness and scope of their respective regulatory and institutional approaches. The research also encompasses the analysis of emblematic cases within the banking sector, such as the money laundering scandal involving Credit Suisse and the corruption case linked to Goldman Sachs, highlighting how certain financial institutions may engage in or facilitate illicit schemes. Furthermore, the strategies adopted by banks to prevent their misuse by criminals are explored, with particular emphasis on preventive monitoring and control procedures. The study also discusses client categories that demand enhanced due diligence measures due to their higher risk profiles. Finally, the dissertation presents a forward-looking perspective on the future of compliance departments within the banking sector, considering the integration of artificial intelligence as a tool for both support and transformation of this function, while also acknowledging the risks associated with technological advancement.
