The object of this work is fixed term contracts and how they are used as an employment policy. We intend to show that in this domain there are standards which show weaknesses from the point of view of their compliance with major principles of the legal system. At first, we are going to assess article 140/4/b, by focusing on the category of employees seeking for their first job and, after that, we are going to analyze article 348. We will conclude that both prescriptions give rise to issues concerning their compliance with the principle of job stability (article 53 of the Portuguese Constitution) and, as far as the latter legal provision is concerned, also with the European Union Law, mainly at the level of discrimination on age grounds.
