The present study aims to understand if, in the Portuguese legal system, it is possible to hold the directors of a company accountable for decisions that harm the various stakeholders. The discussion of Corporate Social Responsibility has been amplified since the 50's of the 20th Century until now, due to its importance in the construction and maintenance of relations between a company and, for example, clients, investors or employees. In this regard, it is noted that companies are increasingly being required to adopt social measures. However, it is important to understand whether the Portuguese legal system, mainly through the Portuguese Constitution and the Commercial Companies Code, enables the liability of directors for measures that are harmful to the stakeholders that are essential for the sustainability of the company.
