Da constituição do contrato de arrendamento comercial

Abstract

The present study, under the Urban Lease Law, deals with "The Constitution of the Commercial Lease Contract". It seeks to define the elements to be included in the text of the urban lease contract and discuss its substantial, formal and effective requirements, following the legal discipline of the various applicable legislation, in particular our Civil Code and Decree-Law no. 160/2006, as amended by Decree-Law no. 266-C / 2012, of December 31. It also explores two typical clauses of this contract: the bond and the bail. The main objective is to engage a legal analysis on this subject, with a critical approach, raising some important issues, with references to the doctrine, court decisions and conclusions of the Author.
