Our dissertation seeks to analyse and explore the problem of debt-equity bias at European level, more precisely the European Council's approach to implementing measures to mitigate this problem, based on the DEBRA Directive. Starting with an approach to the problem, which deserved the initial attention of the European Commission, the dissertation will analyse the Directive and its approach to the situation, followed by a critical study of the solutions available to the Council to combat the bias, analysing the means chosen and their effectiveness, conciliating the European Commission’s intention with Portugal´s tax system regarding the encouragement of company capitalisation. Finally, in a constructively critical tone, we will try to identify the drawbacks of the Directive, combining them with the approach that, in our opinion, is most appropriate.
