Abstract

The present master’s dissertation aims to analyze, under the Law for the Protection of Children and Young People in Danger, how are the principles of the best interest of the child and the prevalence of family articulated, through the actions of the protection commissions and courts. In conflict may be the child’s right to the satisfaction of their needs, one of which is the elimination of the dangerous situation, which allows them to subsequently live harmoniously, within a family, and the parent’s right to education and maintenance of their children. The aim, therefore, is to know whether the state intervention is carried out through an adequate balancing of the interests in question or whether, on the contrary, it exceeds or falls short of the postulated admissibility requirements.
