Abstract
This dissertation looks at age discrimination and the impact of employment policies on the labour market in relation to younger and older people. It analyses rules in the Portuguese Labour Code, such as Article 112 (which increases the probationary period for workers looking for their first job) and Article 348 (which converts fixed-term contracts after retirement due to old age or reaching the age of 70). The compatibility of these rules with European Union law and constitutional principles, such as the principle of equality and job security, is examined. The research concludes that certain policies, while aimed at promoting the employability of these categories, can increase the precariousness of young people and the exclusion of older people, which calls for a better balance in labour policies.| Date of Award | 25 Jul 2025 |
