Abstract

The object of this master's thesis deals with the content of Good Faith and the boundaries of the third way in civil liability: mainly, the culpa post pactum finitum institute. After we distinguish it from the liability for wrong inspire confidence in someone or something, at first, we discuss the nature and legal regime of post-contractual liability and take a position on the possibility of inserting the violation of post-contract protection duties under the third way of civil liability: a hybrid legal liability. Then, we analyze the practical legal consequences in terms of the distribution of the burden of proof in that post-contractual liability.
