The growing use of covert methods as a way of cracking down on organized crime and the search for an effective investigation give rise to complications in terms of compatibility with a guarantee-based criminal process. Environmental home tapping is no exception. In this paper, we problematize the admissibility of home environmental eavesdropping, analyzing and interpreting article 6 of Law no. 5/2002, weighing and analyzing the rights and interests in conflict.
