This dissertation intends to analyze the relationship between the crimes of slavery, human trafficking and swindle related to work or employment, as well as to answer the practical problem of delimiting the scope of these crimes, when labour exploitation contexts are at stake. To this end, based on a doctrinal and jurisprudential investigation, this study begins with the presentation of a global view on the evolution of each of the aforementioned incriminations and the legal assets they protect, seeking, subsequently, to characterize the concept of “labour exploitation”, to understand in what situations this type of exploitation can be configured as “slavery”, to distinguish the crimes of slavery and of human trafficking for the purpose of labour exploitation, to analyze the relationship between the crimes of slavery and of human trafficking for the purposes of slavery and, finally, to answer the question of whether, today, it is necessary to maintain the crime of swindle related to work or employment in the portuguese Penal Code.
