The mere lack of retribution payment is not, by itself, a sufficient legal motivation for the employee to terminate the employment contract. Several other parameters must be considered, such as the culpability of the employer. This research also focuses on the deadline that shall respect in case of termination, as well as on the discussion concerning the moment the deadline commences, countdown for this deadline commences, and as well on the procedure which must be assumed by the employee, aspects that are not clearly legislated by the Labour Code 2009.
