Discussing intellectual property in the context of fashion is becoming increasingly pertinent. This is a highly competitive field where the supply and demand are determined by creativity and novelty. Copy and imitation are common practices which have been fostered by the easy access to information and by technological developments. It is the Law’s obligation to regulate these matters but the difficulties in applying industrial property regimes to the creative industries have also contributed to the generalization of piracy. Nevertheless, the impact of such dynamics has been the opposite of what could be expected and the sector remains vibrant. In a field such as fashion, characterized by volatility and change, imitation has been a driving force, which confirms the need to discuss intellectual property, particularly in this area. This work is focused on the impact of the copy in fashion and in the intellectual property regimes that regulate it, but also in the challenges and opportunities it offers.
