Abstract

Risk and Protective Factorsof juveniledelinquency have been widely discussed as important indicators for a substantiated and appropriate prevention and intervention, to this phenomenon (Hawkins et al, 2000; Holmes, Slaughter & Kashani, 2001). It is known that risk factors of juvenile offending have been understood as those which increase the probability of occurrence of an antisocial and delinquent behavior, while protective factors indicators have been defined as those which inhibit its incidence (Matos, Negreiros, & Gaspar Simões, 2009). Over the last years, many authors have been carefuly categorize the different risk and protective factors (eg, individual, peer group, relational, family) (Shader, 2003). With a particular focusing on the relation of family factors to peer group and context, this study aims to identify risk and protective factors in a sample of young people who fulffil legal system´s measures under the Portuguese Educational Guardianship Law, No. 166/99.To this end, the MERLINO questionnaire was administered to 105 young people aged between 14 and 17 years old, located in the metropolitan areas of Lisbon and Oporto, who were under legal measures in young offender institution/educational institutions and in community. The study concluded that the criminal conduct of the peer group are associated to young people under legal community measures, older minors and, also, young people with a higher number of previous contacts with the law. Data were discussed and based on the developmental perspective, and focused on specificities of the risk and protective factors in family, peer group and contextual (eg, Farrington, 1987 LeBlanc & Fréchette, 1987, Loeber, 1988, Moffitt, 1993, Agra and Matos, 1997 Ferreira, 1997 Born, 2005 Negreiros, 2008).
