Abstract

The limits on the claims of the beneficiaries of autonomous guarantees have been a fertile field of doctrine over the last half century, and it is around these limits that most of the litigation regarding autonomous guarantee contracts is centered.
In this research, we intend to reflect critically on the limits of the autonomy and automaticity of autonomous guarantees, with particular emphasis on the study of the limits to the invocation of abuse of the beneficiary's right to credit (focusing, with greater attention, on the proof of the lack of material basis of the request).
