The following dissertation addresses the possibility of an «Automated Judge». The recent technological developments on artificial intelligence brought us the possibility of automatizing the judicial activity, demanding an in-depth investigation on these new systems’ functioning and their ability to efficiently reproduce a judicial argumentation. So, the questions at hand are: Is an automated judge possible? Then, how can we accurately emulate the judicial thought process? To reach an answer, we´ll focus at first on the different elements of judicial reasoning, beginning with its assumptions (language and logic). Then, we´ll discuss the automated reconstruction of the normative proposition, from the facts’ selection to the judicial decision discourse. We hope this dissertation will translate in a useful contribution for the better understanding of these new technologies and their relationship with the Law, as well as foster the curiosity for this new reality.
