Abstract
In the course of this dissertation, we aim to examine and reflect on educational tutelary intervention. Faced with the phenomenon of juvenile delinquency, Portugal has decided that the educational needs for Justice should guide and justify the application of educational measures to minors between the ages of 12 and 16 who have committed acts classified by law as crimes. The measure of custody in an Educational Center is the last resort. Since it necessarily involves the deprivation of the minor’s freedom, the controversies surrounding it have lasted over time: from the paradox of preparing for freedom through deprivation of freedom to the challenges related to the minor’s exit from the Center after custody. While some claim that the measure is irrational because of the contradiction it contains, others see it as a real opportunity to change the life path of young offenders. Based on an analysis of the doctrinal contributions on the subject, we will try to understand what the measure’s potential is and how failures can be transformed into triumphs.| Date of Award | 13 Nov 2024 |
