Abstract

This dissertation aims to investigate whether the implementation of restorative solutions in parallel to the fulfilment of criminal sentences has an influence on the fulfilment of the purposes of criminal sentences. To this end, an analysis of Restorative Justice will be carried out, trying to define it conceptually and analyse the purposes that are intended to be fulfilled. Furthermore, a brief analysis will be made of criminal mediation and its current paradigm in Portugal, assessing the possibility of its implementation at the stage of sentence fulfilment. The various theories about the purposes of criminal penalties and the adequacy of these institutes for their fulfilment will also be explored.
