The present thesis purpose is to provide a reflection on the legal questions associated with employment contract cessation through dismissal of the worker disability or maladaptation. It Seems relevant to define and distinguish both figures, as well as doing an analysis on their requirements. On the other hand, and because this problem is strongly associated with discrimination, we approach the relationship between the principle of equality due to disability and the right to a reasonable adaptation, at the light, – of the European Union Law.
