Abstract

The crime of domestic violence (article 152 CP) represents a serious threat to
human rights and, therefore, must be fought. The Portuguese legislation provides a set of measures that will protect the victims of domestic violence. One of the measures provided can be found in article 200/no. 1/d) CP, that states an enforcement measure of removal order from the accused (a criminal restraining order). In this dissertation, I intend to analyse the enforcement measure of removal order from the accused and its efficiency, as well as suggesting a new measure in order to protect the victim and his/her rights.
