The current study details succession planning strategies and family governance as proactive methods to prevent litigation in family businesses, particularly during and after the transfer of wealth and business control to future generations. It emphasizes the importance of Shareholders' Agreements and Family Agreements, not only as instruments for establishing clear guidelines for management and transfer of control but also as essential mechanisms for the inclusion of dispute resolution clauses, namely by means of mediation and arbitration. The study presents a comparative evaluation of the Portuguese and Brazilian legal systems, highlighting the nuances and intersections of Inheritance and Corporate Law in both jurisdictions, with the aim of understanding the most efficient practices for the management of internal disputes and conflicts resulting from the complex dynamics between family and business.
