Abstract
Artificial Intelligence is one of the hot topics of the moment, especially because of the significant advances achieved by the industry. Whilst this technology brings massive benefits to society, it can also be potentially dangerous. And deepfakes of non-consensual intimate content, which have damaging repercussions on the lives of victims, are an example of these dangers. The need to combat this new form of digital violence gave rise to Article 5(1)(b) in Directive (EU) 2024/1385. It criminalises the creation and ensuing dissemination to the public, without consent, of generated or manipulated content that represents the idea that the person is taking part in explicit sexual activities. Portugal, as a member state of the European Union, will have to implement the Directive and, as a result, it is essential to check whether our current legal system provides a satisfactory response to criminalisation or whether it is necessary to create a legal type.| Date of Award | 15 Sept 2025 |
