The historical totality that permeates the migratory flows from the twentieth century onwards is configured by societal changes in the face of globalization, demographic movements and political-economic transformations that promote the densification and complexification of migrations and challenge the adoption of measures that relate organization, security and attention to the human rights of migrant populations (Carvalhais, 2010; Ferreira & Vieira, 2010; Mahendran, 2017; Waerniers & Hustinx, 2019). In the European Union, the ethical-legal logic directed to migration is permeated by a double perspective: the transversality of normatives that aim to guarantee human rights and citizenship for the immigrant population and, the adoption of measures aimed at the containment and management of migration flows according to their political-economic interests (Carvalhais, 2010; Carvalho, 2018; Guia & Pedroso, 2015). In this framework, we intended to analyze from the experience of Brazilian immigrants in Portugal, which social and subjective meanings are produced from the wait in the regulatory processes of residence, constituting a locus of analysis that highlighted the expressions of the social issue transversal to the contexts of access to human rights and citizenship conditions. The research design was established based on qualitative procedures, with a mixed approach, through semi-structured interviews and online surveys directed at the Brazilian immigrant population living in Portugal. Data were collected between the months of June 2021 and July 2022, and were analyzed from categories defined in the analytical conceptual map of the research, through content analysis and statistical analysis, with the use of Atlas.ti 9 and SPSS software, respectively. The configuration of the waiting of Brazilian immigrants in Portugal allowed us to unveil mechanisms underlying oppressive models of power relations and denial of rights to the immigrant population, in addition to highlighting the production of the labyrinth of state practices that produce vulnerabilities, social risks and a postponed citizenship, which distances the ethical-legal logic of the Portuguese migratory context from the desired prerogatives as guarantors of human rights.
