Abstract
This dissertation analyses the duty to abstain from contact enshrined in Article 199-A of the Portuguese Labour Code, assessing the national response to the challenges posed by the spread of new information and communication technologies (ICTs) to the phenomenon of permanent work connectivity. It begins by highlighting the changes the 21st century has brought to the delimitation of working time, which have led to the need for a “right to disconnect.” After some preliminary considerations on the national context, the elements of Article 199-A are examined, and conclusions are drawn regarding its merit and effectiveness. Finally, a brief reflection is offered on possible ways to strengthen the protection afforded by this provision, with particular emphasis on collective bargaining.| Date of Award | 4 Sept 2025 |
