The European Certificate of Succession was created by Regulation (EU) n.º 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession with the purpose of creating a single, user-friendly document for the quick, easy and effective outcome of European transnational successions. From this perspective, and without prejudice to the legislative diversity of the Member States, the main objective of the European Certificate of Succession is to prove the status and/or rights and powers of the heir, legatee, executor of the will or the administrator of the inheritance in another Member State. This study constitutes a reflection on the European Certificate of Succession’s regime and on the difficulties that were experienced regarding its implementation in the first years of its validity.
