O compliance no combate à corrupção no setor público e no setor privado

Abstract

It is undeniable that compliance has been given enormous importance in recent years, reinforcing the importance of acting in accordance with the law in force. Implementing compliance programs strengthens the preventive aspect of criminal law, guaranteeing ex ante action by preventing and detecting crimes. In view of the growing trend in corruption crime, the government has developed the National Anti-Corruption Strategy 2020-2024, whose essential vector for tackling the corruptive phenomenon is prevention. In accordance with the Strategy, Decree-Law n.º 109-E/2021, December 9th, was published which, in addition to creating the National Anti-Corruption Mechanism, establishes the General Regime for the Prevention of Corruption. The Regime makes it compulsory for public and private entities to adopt a compliance program, the application of which must be monitored and guaranteed by the compliance officer. Thus, I intended to analyze compliance programs and compliance officers and their functions, as provided for in national legislation, as well as their importance in preventing the commission of corruption crimes in the public and private sectors.
