Abstract

The aim of this work was to explore the possibility of subjecting the defendant to decryption of data/personal files stored on a smartphone and/or computer, focusing mainly on US and Portuguese doctrine and jurisprudence, in order to frame the issue. Technology is present in the daily routine of all citizens and the panorama will not change, with the advanced devices increasingly capable of storing data and information it is undeniable that the digital evidence gains breath and its obtaining and preservation are of extreme importance for the authorities.
