O crime de fraude na obtenção de subsídio

Abstract

This dissertation concerns the crime of subsidy fraud, enshrined in DecreeLaw no. 28/84, of January 20th, which, although dated, fundamentally covers economic and public health criminal law. Article 36 of this decree was inspired on a similar offense in the German penal code, which is why comparative law is the starting point for this dissertation. This is followed by an exposition of the characterising elements of this legal type of crime. The aim of the work is not only to explain the nature of the legal type, but also to propose adjustments that guarantee its effectiveness and suitability to contemporary challenges.
