Abstract

In this dissertation we are going to analyse the crime of injury to serious physical integrity, more specifically the first part of al. a) relating to the deprivation of an important organ or limb. The concept of deprivation and that of important organ/member have not been unanimous in our legal system, which is why this topic is current and arouses our interest, particularly with regard to the various solutions adopted by our jurisprudence, which in some cases cause us strangeness, and the lack of criteria for determining the importance of the organ/member. We have therefore carried out a theoretical and practical analysis of our legal system and the Spanish legal system in relation to the crime of serious bodily harm involving the deprivation of an important organ/member, in order to be able to reflect on and comment on the various controversial issues encountered during our analysis and propose criteria for defining the controversial concepts, as well as amending/updating article 144.º, a) of the Portuguese Criminal Code.
