: análise aos elementos objetivos

Abstract

Corruption has always been understood as a complex phenomenon of high social damage that affects not only the State, but all citizens in general. Thus, attempts have been made to fight this phenomenon and the impacts that it may cause, through the creation of various legislative measures. It is in this context that, in 2010, the crime of receiving undue advantage is created, which punishes the conduct of requesting or accepting, giving or promising an undue advantage that occurs in the exercise of the employee's duties or because of them. In the present dissertation, it is our objective to analyze the crime foreseen in article 372 of the Penal Code, specifically, its objective elements.
