Stalking is a form of repeated and unwanted violence against another person, especially on the private sphere of another person, consubstantiating in intrusions by the agent of the crime that can vary between waiting for the victim in his place of work and pursuing it to his residence, among others. As far as the Daphne Project carried out by the European Commission, up to 2007, of the Member States of the European Union, only eight to date of the study had established anti-stalking legislation and Portugal was included until August 2015 in the 17 countries that remained on the margins of this social problem. The purpose of this dissertation is precisely the legislative amendment that has taken place in relation to this theme and its exploration.
