This thesis intends to address some fundamental issues that arise during the award phase, a remarkable phase that represents one of the key moments in public procurement procedures.Fundamentally focusing on articles 76 and 79 of the Public Procurement Code, the work under consideration is divided into two chapters that are logically interconnected: i) the first chapter addresses the subject of the award decision and, in particular, the obligation to award a contract, as provided for in article 76 of the PPC, its evolution and the grounds on which it is based; ii) the second chapter analyses the subject of the non-award decision, the causes of non-award, according to article 79, and its completeness or mere typicity. At the end of the dissertation, the main conclusions reached are presented.
