At first, with a general approach, this dissertation begins with a brief assessment of the European Convention on Human Rights and the Human Rights Act, moving on to an analysis of the principle of non-discrimination provided in article 14.º of the ECHR and article 5.º of the same diploma. Once the legal basis has been established, we are transported to the execution of the detention with the intent to deport immigrant citizens in the United Kingdom. Unable to set aside the current paradigm lived in the United Kingdom, we turn to the analysis of the new immigration system, including the new residence permit scheme – European Union Settlement Scheme –, and the new means of contestation in case of violation of citizens’ rights with Brexit.
