Mental Health has become increasingly important, in the sense that there is a bigger concern to fight possible health problems, although it remains a real stigma to society. Thus, Mental Health at work is also indispensable, especially in terms of the impact that work can have on it. Inherent to Mental Health, there are new risks emerging from today's world of work and are increasingly being considered by law, especially in Safety and Health Law at Work. In this respect, we address the psychosocial risks and their influence on work at both organizational and individual level. Therefore, it is interesting to look into the influence on worker's health, especially on his/her mental health, of a psychosocial risk in particular. We refer to the Burnout Syndrome or the Job Burnout. Thus, we try to understand the reparation of Burnout as a work-related accident or as occupational disease in other jurisdictions, more particularly in the Spanish legal system, in order to understand its effects on worker's labour situation. In this way, we open the discussion on a possible normative regulation of Burnout in the Portuguese legal system.
