The definition of refugee from the 1951 Convention and the 1967 Protocol come from undetermined concepts, from which the well-founded fear assumes particular importance. Determining the ratio of the figure and the considerations that UNHCR makes about it are the starting point of our study. Analyzing the approaches taken by the decision makers in the treatment of the figure and confronting it with the Convention to understand the implications that “fear” and “well-founded” have in the determination of the refugee status, reveals itself fundamental. Questioning the nuances of the regime when it comes to applications based on sexual orientation is the main goal.
