The object of this work is the study and systematic analysis of two legal branches, Consumer Law and Financial Instruments Law, confronting the legal figures, consumer and investor. Through the confrontation between these two figures, we try to find out if the person who resorts to credit to invest in stocks can be qualified as a consumer and his credit subsequently considered as a consumer credit. Based on a balance between the different characteristics of both the legal branches and the legal figures in question, it is difficult to defend the qualification of an investor, even a non-professional one, as a consumer.
