The present dissertation addresses the theme of legal deficiencies in the legal regime applicable to crimes committed by young adults. According to the preamble of Decree-Law no. 401/82 of September 23rd, even though young people come under criminal law and are subject to common penalties from the age of 16, they are still at the threshold of maturity. Therefore, criminal responses should be adapted to facilitate the transition between the Educational Tutelary Law and the penal legal system, aiming for a more effective social reintegration of young people. This transitional regime is essential for crime prevention and stands out for its importance in the social reintegration of young adults. Our approach involved assessing the established age of criminal responsibility, critically analyzing the current legal regime for young adult offenders, and studying Proposal Law no. 275/VII. Additionally, we dedicated a specific chapter to analyzing the challenge related to the execution of prison sentences for young people. With our study, we aim to highlight a problem that is often overlooked and propose the implementation of fundamental improvements to optimize the social reintegration process of young adults, believing in their greater potential to reintegrate into society effectively than adults.
